1. Eligibility & Acceptance

• Net weight is measured at time of packaging and may decrease slightly due to natural moisture evaporation.
• Botanical ingredients, natural colorants, and essential oils may vary slightly based on supplier and season.

3. Cosmetic Disclaimer

• Our products are cosmetic and cleansing products only.
• They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
• Statements on this website have not been evaluated by the U.S. Food & Drug Administration.
• You agree to use products only as directed and at your own discretion and risk.

4. Skin Sensitivity, Allergies & Assumption of Risk

• Customers are responsible for reviewing full ingredient lists prior to purchase.
• By purchasing and using our products, you acknowledge:
  • You understand that natural oils, butters, botanicals, fragrances, essential oils, and other ingredients may cause sensitivities in some individuals.
  • You assume full responsibility for testing products prior to full application.
  • You release Wisconsin Waterfall Soaps, Etc. from liability for allergic reactions, skin irritation, misuse, or adverse outcomes.
• If irritation occurs, discontinue use immediately.

5. Pricing & Payment

• All prices are listed in U.S. Dollars.
  
• We reserve the right to:
  • Modify pricing at any time without notice
  • Correct pricing errors
  • Cancel orders due to pricing inaccuracies
• Payment is processed through secure third-party processors. We do not store full credit card numbers.

6. Order Acceptance & Cancellation

• We reserve the right to:
  • Refuse or cancel any order
  • Limit quantities per customer
  • Cancel orders suspected of fraud or resale without authorization
• If your order is canceled after payment, you will receive a refund to the original payment method.

7. Shipping & Risk of Loss

• Shipping timelines are estimates only and not guaranteed.
  
• Wisconsin Waterfall Soaps, Etc. is not responsible for:
  • Carrier delays
  • Lost or stolen packages marked as delivered
  • Incorrect shipping addresses provided by the customer
• Risk of loss transfers to the customer once the order is delivered to the shipping carrier.

8. Returns, Exchanges & Refunds

• Due to the hygienic and personal nature of bath, body, and cosmetic products:
  • All sales are final.
• We do not accept returns or exchanges.
  
• If a product arrives damaged or incorrect, you must contact us within 5 days of delivery with clear photographs. Remedies may include replacement or store credit at our discretion.

9. Farmers Market & In-Person Sales

• All in-person sales, including but not limited to farmers markets, pop-ups, and local events, are final.
• Customers are responsible for:
  • Reviewing ingredient information available at point of sale
  • Asking questions prior to purchase
  • Inspecting products at time of purchase
• Once a product leaves our physical sales location, we are not responsible for:
  • Improper storage (e.g., heat exposure, freezing, moisture damage)
  • Melted, cracked, or altered products due to environmental conditions
  • Loss or damage after transfer of possession

 

10. Wholesale Terms

• Wholesale accounts must be approved in writing.
• Wholesale customers agree to:
  • Pay invoices according to agreed terms
  • Resell products in original packaging without alteration
  • Not modify labels, remove trademarks, or make unapproved claims
  • Store products properly in climate-controlled conditions
  • Comply with all local resale laws and cosmetic labeling regulations
• Minimum order quantities may apply.
  
• Wholesale orders are final sale unless otherwise agreed in writing.
  
• Wisconsin Waterfall Soaps, Etc. is not responsible for damages caused by improper storage, resale handling, or third-party claims made by wholesale retailers.
  
• We reserve the right to terminate wholesale relationships at any time for misuse of brand assets or policy violations.

• Collection names
• Descriptions
• Photography
• Logos
• Label designs
• Marketing materials

12. Limitation of Liability

• To the fullest extent permitted by law, Wisconsin Waterfall Soaps, Etc. shall not be liable for:
  • Indirect, incidental, punitive, or consequential damages
  • Loss of profits
  • Misuse of products
  • Improper storage
  • Third-party resale conduct
• Total liability shall not exceed the amount paid for the product in question.

13. Indemnification

• You agree to indemnify and hold harmless Wisconsin Waterfall Soaps, Etc., its owner, and affiliates from any claims, damages, losses, liabilities, or legal fees arising from:
  • Misuse of products
  • Violation of these Terms
  • Resale violations
  • False claims made by third parties

14. Governing Law

• These Terms & Conditions are governed by the laws of the State of Wisconsin, United States.
• Any disputes shall be resolved in the appropriate courts located in Wisconsin.
